Terms of use
The Neuroplasticity Gym and NAX are training tools. They are experimental, they are not medical devices, and they don't diagnose or treat anything. If something hurts, see a clinician first. Nothing is charged today. These terms explain the rest.
Who these terms are with
These terms are an agreement between you and MVMTLAB Inc., 28, av. de la Gare, bureau 202, Saint-Sauveur (Québec) J0R 1R0. The Neuroplasticity Gym and its app, NAX, are MVMTLAB products.
By using this website or joining the early-access list, you accept these terms. The NAX app will have its own terms at install, written in the same spirit.
Training, not treatment
- The Neuroplasticity Gym and NAX are strength, stability and coordination training tools.
- They are experimental. They are not medical devices.
- They don't diagnose, treat or prevent any disease or injury.
- Joint angles, load estimates, the twin and any score built from them are labelled experimental. A lit muscle on the twin means a hold met the program's standard. It is not a measurement of muscle activity.
If pain is new, severe or getting worse, see a clinician before you train. In an emergency, call 911.
Train within your limits. Stop if a position causes sharp or increasing pain.
What we say, and what we don't
The method was developed in clinical and high-performance practice since 2010. It is built on methods shown in trials to reduce injury and improve balance.
We don't promise results. Your results depend on you, your body and how you practise. We won't call the method proven until our own study shows it.
Prices
The prices on this website are planned launch prices. Nothing is charged today. Before you pay for anything, you will see the final price, taxes and the cancellation terms, and you will confirm.
Clinic patients
For clinic patients, NAX is part of care. There is nothing to buy to follow your plan.
Clinical services are never paid for in advance. Your clinician approves your plan before it appears in the app. Clinical care itself is governed by the clinic's own policies and by the rules of the clinician's professional order.
Acceptable use
Please don't:
- copy, resell or republish the programs or the site's content;
- try to break, overload or get around the site's security;
- sign up someone else without their permission;
- use the site for anything unlawful.
We may refuse or end access if these terms are broken.
Intellectual property
The program names Ground Control, Shoulder Codex, Balance Day and Cohort 90-Day, the method, the text and the design belong to MVMTLAB Inc. You may use them for your own training. You may not reuse them commercially without written permission.
The 3-D twin uses models made by others, which stay under their own licences:
- skeleton from Open3D, licensed CC BY-SA 4.0;
- muscles from BodyParts3D, The Database Center for Life Science, licensed CC BY 4.0.
Their geometry is unmodified. Only colours change on screen.
Liability
We work to keep the site accurate and available, but we can't promise it will always be error-free or online.
To the extent Québec law permits, MVMTLAB is not liable for indirect losses that come from using the site or the training. Nothing in these terms limits our liability for intentional or gross fault, or for bodily or moral injury caused by our fault. If you are a consumer, the Québec Consumer Protection Act and other consumer laws that apply to you prevail over these terms.
Privacy
How we handle your information is set out in our privacy policy.
Changes
We may update these terms. We post the new version here with its date. For a change that matters, we tell people on the early-access list by email at least 30 days before it applies.
Law and language
These terms are governed by the laws of Québec and the federal laws of Canada that apply there. Disputes go to the courts of the judicial district of Terrebonne, unless the law gives you, as a consumer, the right to sue where you live.
These terms exist in French and in English. In Québec, the French version prevails. The parties have expressly wished these terms and related documents to be drawn up in French.
